Protection of minors online in China

On January 1, 2024, the Law on the Protection of Minors in Cyberspace came into effect in China. It aims to create a positive environment for minors online. This is to promote their physical and mental well-being and protect their legitimate rights and interests.

China is proposing a multi-level system to prevent data breaches.

China's Ministry of Industry and Information Technology has released a draft plan for how local authorities and companies will respond in the event of a data security incident. The proposal includes a system of four levels of action, with different response measures tailored to the scale of the incident.

China plans to toughen penalties for cyber security violations.

The Cybersecurity Administration of China ("CAC") recently released a draft Decision to amend the Cyber Security Law of the People's Republic of China. If the CAC adopts the Decision, it will be the first amendment to the Cyber Security Law since its enactment in 2016. Among other things, the Decision provides increased penalties and expanded responsibilities for organizations.
